Recent developments surrounding IEEPA tariff refunds continue to unfold as U.S. Customs and Border Protection (CBP), the Court of International Trade (CIT), and the Department of Justice (DOJ) work through the potential refund process.
While the government has not finalized procedures, current discussions suggest that a structured process for IEEPA tariff refunds could eventually be implemented.
CBP recently indicated that it could potentially implement a process within the Automated Commercial Environment (ACE) to support refunds of IEEPA tariffs. The system would allow importers to identify entries where these duties were paid and begin the refund review process electronically.
However, several factors still affect the timeline:
- The refund process has not yet been finalized
- Legal proceedings and possible appeals may delay implementation
- CBP must complete technical updates before processing refunds
For now, government agencies continue to evaluate how the process will work and when it may begin. If the courts ultimately approve refunds, companies that paid IEEPA tariffs could recover duties and interest on qualifying entries.
